Marketing has proposed a contest to drive our customers to "like" us on Facebook. The prize value is $500.

Basically, the contest will first require the entrant to become a fan of our facebook page by indicating that they ‘like’ us. Once the person has done this, they will officially register for the contest by accessing our Guest Book on our main webpage (not facebook).

Would this be considered a lottery and do we need to open it to the general public or can it just be directed toward customers?

We did a similar promotion a while back. I agree it needs to be open to non-customers as well as customers in order to keep it from being considered a lottery. We advertised the promotion on our outdoor signs & billboards to attract non-customers. Other disclosures stated no purchase or account necessary to win along with the expiration date of the promotion.

Is there anything that would prohibit a bank from giving away a prize for "liking" the banks page? For example, if someone is the 500th person to like our page, we would like to give away a prize for being that person. Would this be considered a lottery?
