We have a loan that will be maturing and the L.O. is going to renew the loan but amortize the loan out and set up escrow, my question is this is not consider Refinance under HMDa unless we pay off the old loan and do a whole new note correct??

correct. You must replace the old with a new. Sounds like you're just modifying what already exists.
