We did not provide a list, because we don't permit, but now we wonder if we should have: It looks like because we didn't provide the list, we are now bound to the 10% tolerance...what say you?

If you didn't provide the list and went against your policy and allowed the applicant to choose the service provider you are indeed bound by the 10% tolerance.

And before someone asks; no, it was not a changed circumstance.
