Initial GFE sent out. Borrower now decides to Escrow Taxes & Ins. Even though these are fees that can change on the Final HUD,they would have affected the "Total Estimated Settlement Charges" in the beginning. F&Q is of no help and I need help now.

Do I have to re-disclose and start the count???? The Closing is set for Thurs. HELP!!!

What count would you be starting? I think you can re-issue a GFE if you choose....you "relied" on the customer not having an escrow account in providing the initial GFE and that changed. There is no waiting period (unless you mail the GFE). So just hand them the revised GFE thursday at closing.

There's no tolerance issues for the Escrow Block so it can change but you should re-disclose as you are now changing fees.

I suppose another way of looking @it, since this is the Borrower's choice and not required for this loan, it wouldn't have to be re-disclosed.

There's only one instance where you HAVE to reissue a GFE and that's when the borrower exercises a rate lock.
