We made a loan secured by stock. The stock is in the name of the borrower's son. The borrower/father is the custodian listed on the stock certificates. The stock was given to the son under the Georgia Uniform Transfer to Minors Act. Can we take this as collateral?

How does the GA UTMA address the issue? My guess would me no you can't unless you can demonstrate the loan was for the benefit of the minor.

Not normally, but you would have to check your State law.

I didn't know if GA UTMA would come into play or not. When in doubt provide too much information.
