The FTC website indicates for ECOA a creditor may not ask:
Ask if you’re widowed or divorced. A creditor may use only the terms: married, unmarried, or separated. However, the model application in Reg B indicates: Unmarried (including single, divorced, and widowed). Why the disparity?

That's just to clarify to the applicant why the bank is not asking about divorce or widows/widowers.....just informing that the term "unmarried" includes those terms. It's not asking the applicant to state anything but "unmarried."

Unmarried includes all three - single, divorced and widowed. You are not asking specifically which the applicant is, you are asking only if they are unmarried, and providing examples of what the regulation considers as unmarried.
