Signed loan documents for a HELOC have disappeared between signing at the branch and inter-office mail to the Note department. The branch has photocopies of the signed loan documents. If the originals do not show up, do we ask the borrower to sign a new set of documents? If so, do we have to start the rescission clock over again when they re-sign? Or can we use the same date that the original docs were signed since we have copies and proof that they were in fact signed and just misplaced?

Ask your legal counsel what to do - this is not a regulatory issue.
