Can an individual be considered an "affiliate" for Regulation W purposes? We are making a loan to one of our directors that will be participated out. I have a lender that states that Reg W will apply and a second lender that disagrees and I am having a hard time finding where an individual would count as an affiliate when reviewing Reg W. Can someone advise me on this?
