TRID Disclosures and Esign

TRID Disclosures and Esign - 01/12/18 05:37 PM

We are just now initiating an Esign program (through software) for mortgage disclosures. So here is my scenario.

The husband submitted the application to the bank but he provided his wife's date of birth and social security number incorrectly. The DOB and the SS# are keys to being able to retrieve and open the disclosures. So the wife was unable to open her disclosures. We now know her correct information (DOB/SS#) and are resending the disclosures.

So.....do we now just re-send the LE that is dated three days ago? And since we are providing hers late (more than 3 days), do we have a TRID violation?

The LE only has to be provided to one of the applicants. You should however resend the appropriate documentation for proper demonstrable consent for receiving documents electronically.
