Attorney Fee for Missed Closing - Need Quick Answe

Buyer couldn't meet down payment so day of closing asked for a postponment. Now attorney is wanting to add an additional fee because of missed closing. Not sure what he would call it. I understand his reasoning. I don't think this is allowable under TRID. Can we legitimately deem this a COC???
