CAN SPAM

The bank recently began sending out emails to customers. They provided the email on the new account worksheet at account opening. We don't send them marketing pieces just info on if the bank will be closed for a holiday, birthday greetings, and customer appreciation events. We followed CAN SPAM rules with regard to what the emails must contain. What are we missing?

I don't really have any at this point. Feedback we have received from the customers seem to be positive. We provide a method to op-out of further emails if customers don't want them.

We recently were told by an auditor that emails of this type should not be sent because they could negatively impact the customer by maxing out the customers email storage and preventing subsequent emails from others to be received. Have you ever heard of that? I thought it was a stretch personally but have heard stranger things. The auditor said it was a CAN SPAM guideline but I'm not familiar with that guidance I guess.

They should stick to auditing and let you run your marketing.

The broad exemption for "transaction or relationship messages." Based on your characterization of your messages, I'd say they are totally exempt from CAN-SPAM.

Issued by whom? Under what authority? Cite?
