Mobile Notification Requirements

We are getting ready to roll out Cash Management services through our online banking product. As part of our risk mitigation, we are going to encourage our CM customers to sign up for and receive mobile alerts for specified criteria. Our question is, can our institution REQUIRE CM customers to do this, or do we have to allow them to opt-out of such notifications?
