Customer opt'd out of ATM and one time debit card ODP.

On 10-3 the customer withdrew $20 from a foreign ATM and was charged an ATM fee of $1. The $1 ATM fee caused the account to overdraw $1. After day 4, the bank began assessing a daily OD fee. Since the ATM fee is part of the ATM transaction, should the bank be assessing the daily OD fee?

In this day and age of UDAAP and ODP being such hot buttons and targets for examiners, it's scary that you'd have to even question this!
