Service Charge for returned NSF ACH

Service Charge for returned NSF ACH - 01/29/16 08:40 PM

Hello all,

For consumers, we have a form that we use if they would like to initiate a one time or recurring ACH transfer. On this form, it states that the customer agrees to have sufficient funds in their account on the designated effective date in order to complete the transaction. They further understand if the transaction is returned NSF, a $5.00 service charge will be assessed to their account and the transaction will be automatically terminated.

My question: Are we allowed to charge the $5.00 return service charge?

What you can and cannot charge is a matter of State law.
