Under the FACT ACT it states that you must send the employment applicant a copy of their consumer credit report and the summary of rights under the FACT act approx 5 days before adverse action is sent. Our credit reporting agency states we cannot give the applicant a copy of their credit report per our agreement as the applicant needs to request the report directly from the credit bureau - is this correct?

If you are pulling a credit report under your contact for use in credit transactions, then you have a problem. You should be pulling reports for employment purposes and they usually fall under a different contract. The credit report for employment usually comes with the proper summary of rights already attached to it.
