I need some clarification on the Fair Debt Collection Act. First, banks are not subject to this law unless they collect debt for a 3rd party correct? Second, does the Act require a "Miranda Warning"? What is this?

Customer opened a savings account joint with son, wife and husband. The wife was the only one who signed the card. The husband came in and closed the savings and now the wife is calling to say he could not do that because he never signed the card. It was not a large sum of money but I need to know where we stand.

I have a question regarding the GLB privacy provisions. Our tellers place customer account numbers in their teller machines as reference to the transaction being performed. If a customer presents a check not drawn from their own account, their account number is placed on the back under their indorsement. By requesting this account number, would this be a violation of the GLB privacy provisions? My thought is that the bank would then be providing non-public customer information to a third party, which is against ourprivacy policy.

I have a question about Endorsements on checks: If there is no endorsement on the back of the check drawn on Bank A in the amount of $20,000 and it is payable to Mary Doe deposited at Bank B in Oklahoma do I return it for lack of endorsement? I thought there was a law passed a few years back that any check with an Oklahoma bank of first deposit stamped on the back you did not have to get the payee's endorsement unless it was a two party check or payable to a business. The Okla. bank automatically guarantees the endorsement. Have all the states adopt this ruling?

We recently purchased matrices that stated a sole proprietorship could have a POD assignment. In the most recent New Accounts Seminar I attended, the instructor stated specifically that they can not have a POD. It has caused a bit of confusion with our other branches. Can you clarify or refer me to sites that I might get this clarified?

Which is the better bank slogan/tagline? We are a small community bank with $270 million in assets. "Independence Bank. Banking the way it should be." OR "Independence Bank. Great Service. Guaranteed Smiles."

A question posted earlier asked for a site for the Equal Housing Lender logo. The questioner was directed to the HUD site. That was a good thing to know except that the only logo there was for Equal Housing Opportunity. Do you where to get EH "LENDER" logo and its usage information?
