We have a customer demanding original checks be returned to him. We do not keep original items beyond a week or two but do have images available. Where can I find the legal information as far as check retention to show him that "by law" we do not have to keep the originals for one year?

A check was presented for deposit without a last name, only a first name. Is it lawful for the bank to type the last name in? They did and I think that is altering a check. What do you think?

When there is a check with amounts differing, I have been taught that the written amount is the legal tender. My question is: Can we write the legal amount above in red? Would this be considered altering? If there are any answers to this, please direct me to the appropriate reg.

A local employer claims that he leaves signed blank checks for company use and payroll during vacation time. One of his employers used one of the checks and computer printed it out for $3000 and he is now threatening to sue us for cashing the check. Does he have any rights at all since he signed the check and do any of his rights revolve around our bank because we cashed it?

We are the depository bank.A drawee bank calls and asks the status on a case they say they sent to us in 2001. We had no record of the case so they faxed it to us (keep in mind it is now 2003) They claim the check was altered and they provided an affidavit. They also state that if our bank will incur a loss we have to provide them with an affidavit of loss per the Reg CC. Is this case too old for us to work now and are we required to send an affidavit of loss?

We have a customer that is trying to claim a forged signature on a check that cleared his account in 2001. Will the bank have to reimburse him for the check or has it been too long? Is there a time limit to claim forgery? Does the bank have any options?

If a customer makes a claim that his Personal Money Order had been altered, do we follow normal procedures as if the MO was his personal check? The MO was not completed when the customer left the Bank; however, the purchaser's copy indicates one Payee and the check indicates another. Normal procedures include completing an Affidavit of Alteration and filing a police report. The checks were issued over 60 days ago.
