Is there an actual code or regulation regarding the ability to give less cash back on a deposit to a business customer? Should you allow the customer to receive less cash or should you only allow the customer to deposit all checks and then write a check for the cash they need. It seems most banks do not allow less cash on a business deposit, but I have not found anything that confirms in writing this practice.

Please cite the UCC rules, and/or regulations that explain our responsibility and liability as a bank regarding the negotiation of checks made payable to a business.For example:Mr. Smith makes a check payable to Hannah Plumbing.Joe Hannah wants to cash the check or deposit it into his personal account saying that he is the owner of Hannah Plumbing.

I am trying to find where in PA Law or UCC it is documented that a Bank is not to cash a check made payable to a corporation. It must be deposited. I have found reference to UCC 3-307 regarding fiduciary duty. Please let me know as soon as possible.

I would like some info on Corporations using an Assumed name to do business. Do you let them deposit checks payable only to the assumed name or the Corp. name or both. Does it matter? What is the liability from a legal standpoint? Account ownership, bankruptcy, know your customer, extended due diligence?
