We have an individual account set up. About six months ago we received electronic notification that the owner is deceased. No family member has come forth to settle this account. In the meantime, seven ACH debits are coming out of the account each month. This is seriously depleting the balance. Given that we know the owner is deceased, should we return these debits? We spoke with a president of a regional ACH association and he told us that ACH rules do not address this issue and he couldn't advise us to return the ACH. His concern was that ACHs that are payments for insurance premiums, house payment, utilities, etc., might have a serious impact to beneficiaries or other folks once that ACH is returned as unpaid. On the other hand, it doesn't make sense to allow an ACH to continue on for months and months. When a check is involved, we return it after 10 days. Seems like ACH should be handled the same way! Any help, guidance or advice is greatly appreciated!

Is the Member FDIC verbage required on an outdoor sign that identifies your bank building? Also, same question for the EHL logo.

I am looking for guidance on telephone transfers from Business LLC or LLP to one of the owner's personal accounts. Should this be allowed?

We have a joint account with durable POA and a Trust as POD. Two CDs came due and the POA wanted to come in to change the term from 30 months to 6 months. This entails closing old CD and opening a new one. Everything else remains the same. ( POA and POD) Can a durable POA conduct that transaction on behalf of the account owner?

A check deposited at our bank on Nov 2, 2012 was returned to us for a cash letter dated Jan 25th for unauthorized signer (stolen). We returned it for lateness but have received it back from the Payor bank with a signed affidavit of Alteration. It is not altered, it is a stolen check. We want to send it back to bank without entry. Can we?

We have a new overdraft policy that went into affect on 4/1/13. We do not offer overdraft protection. We are charging $30.00 per item for presentment or representment. What is the max number of OD fees that should be charged? I think anything over 4 is excessive. I would like to change our policy to have a cap of 4. What are your thoughts?

An individual deposits a check made out to himself into a checking account owned by his closely held corporation. The check was not endorsed over to the corporation. If the check is returned, can we legally charge it back to the corporation?

We have branches that are renting safe deposit boxes for use of storing spare combinations, keys, etc. I do not find anything in state law that says this practice is unacceptable, but am wondering if there are any implications of doing this.
