In the state of North Carolina, what is the wording needed to go in a POA to enable an attorney-in-fact to act on behalf of a sole trustee? Example: a husband is grantor and sole trustee. He wants his wife, who is his attorney-in-fact, to be able to sign on a bank account for the trust.

We are located in Pennsylvania. The Power of Attorney laws changed January 1, 2015, and now require our loan documents to be notarized when a confession of judgment clause is present. Many of our loan officers are notaries. Do you see a conflict if a loan officer who approved the loan also acts as the notary when documents are signed? Loan officers do not receive commissions.

What is the role of an attorney-in-fact (AIF) on a checking account, and if the account holder becomes incapacitated and has a POA but the bank will not accept the POA documentation, can the AIF withdraw funds for the account holder?

We have two Trustees who are deemed incompetent by their physicians, and the successor trustees are willing to step up. However the trust is using one of the trustee's TINs. Can the successor sign the W9 section? They also have a POA drawn up, however it doesn't grant powers over the trust, just the trustee.

Older member has died, under $70.00 in the account. She really had nothing and they have paid for the funeral. There is no will, they are not going to the trouble to legally have an executor appointed or whatever is needed over less than $70.00. Is there something we can type up her son & daughter-in-law could sign to close acct and receive funds? (they were both her POA) Any advice at all would be appreciated.
