We have customers who initiate the same Reg E wires, for the same amount, to the same country, each month. The required disclosures are read to the customer each time. Can this disclosure requirement be waived if the customer sets up the wire as a Standing Order or sets up the wire to be an STO?

With the recent addition of gambling apps in states where gambling is legal, would the app that they sign into be considered an access device and if we do the investigation and the casino sends us where the gambling took place and this is in range of the customer's address - deniable? What is considered a access device? User name and password? A verification that the app has the proper access to the bank account or card?

If when doing an investigation and determine it was a family member who did the transaction - if the customer asks what will happen to the family member if they continue with the claim, can we tell them that the Bank or merchant could and or will go after the family member to recover the funds?

In Reg E, our customer disputes ATM withdrawals from August 2021 until present, July 2022. She 'claims' someone must have taken her card out of her wallet and replaced it. We are working with the police to get video footage at the ATMs for over 109 transactions. As I understand Reg E, we begin with the first unauthorized withdrawal and count 60 days from date of statement for that charge. The remaining unauthorized transactions that occurred after the 60 days are not covered under Reg E. Is that correct?

We currently have a $200 per day ATM withdrawal limit and are planning to increase that amount. The limit is not in our fee schedule, but is included in our EFT disclosure. Would it be sufficient to add language to our customer statements informing them of this change, or should we send an additional notice separate of the statements?

The question is about Reg E. If a customer has already been advised of a permanent provisional credit and later the merchant issues a credit for the same amount which was contested, can we reverse the permanent provisional credit we issued as the account now has two credits for disputed mount?

Is there a time limitation for a consumer to present a Reg E claim? As an example, our customer is claiming a transfer from Jan 8, 2020,
after more than 4 months.

I have been unable to find in Reg. E where it references a "day 0". Can you provide some background on day 0?

In a case where a customer uses a CASH APP and states the transaction was unauthorized, we are responsible for Reg E compliance and we can't use 1005.14 because the Bank and Cash app both have agreements with VISA MC? Also, I don't understand how it could be unauthorized when within the app, it has an authorized button?

What about asking for a police report when a claim is made, can we do that?
