On files that are closed for incomplete, we have been using the date the form expires as our action date for several years now, but your manual states, the date of the form. Do we need to be looking to change that, or since we have been doing it this way for several years, do you think we will be OK as long as we stay consistent?

Answer:

The information in the manual reflects the language used in the Official Staff commentary. Apparently examiners have not noticed that you use a date other than that prescribed in regulation. They may never notice; but, we suggest following the commentary.
