Why can't we hold a customer or member liable for having the PIN with the card?
Answer: 

The regulation is clear and even offers this as an example in the commentary:

"Negligence by the consumer cannot be used as the basis for imposing greater liability than is permissible under Regulation E. "

A key in reducing losses from this scenario is to remind your customers to memorize their PINs and not to write them on their card or keep them in their wallets or purses.
