Most consumers only use a mobile device these days to access their online banking. Is enrolling and accepting e-statements on a mobile device compliant with a consumer demonstrating consent?

The consumer doesn't have to demonstrate consent. He or she must demonstrate the ability to receive or access the electronic document that is the subject of the consent.

So, if, as part of enrolling and accepting e-statements on the mobile device also demonstrates the ability to access or receive an e-statement in the way that e-statements will be provided, the answer is yes.
