Crop Liens Should be Filed Where?

Answered by:

Question:
To perfect a lien on crops, where should we file? Several seminars have said to file at the state; however, our bank does not feel comfortable not filing a lien at the county level.
Answer:

The proper place to file is governed by provisions of Article 9 of the Uniform Commercial Code (UCC) adopted as your state law by your state legislature. The proper office in which to file can and does vary from state to state. Check with your bank attorney to clarify where you need to file in your state.
