Customer Passes Away-Rep Payee/No Beneficiary

Answered by:

Question:
What happens to a customer's account when they pass away and they have a representative payee and no beneficiary? Does this go to probate or how do I as a personal banker handle the account?
Answer:

Assuming you have actual notice of the death, if you have not received a DNE notification from SSA, you notify them of the death and return subsequent SSA payments. If your bank issued an ATM or debit card (some will not on these types of accounts) suspend its functionality.

The representative payee no longer has control over the account and debits presented after the date of death should be reviewed based on their type; e.g. under the model version of the UCC, checks written prior to the date of death may be paid for up to 10 days after the date of death. ACH debits must be evaluated on a case by case basis; there is no firm rule regarding their continuing payment like there is on checks.

A representative payee is not empowered to appoint a POD beneficiary - there should never be one on this type of account. Accordingly, it's just like any other individual account owned by a decedent - you wait to be contacted by a duly appointed personal representative.
