A widowed wife brings in a recently dated check for her deceased husband who passed away 7 years ago. He is no longer listed as a signer on the account. Can the check be cashed or deposited? What should be done with the check?
Answer: 

If seven years have elapsed since her husband's death, the odds are high that any probate proceeding has terminated. The check cannot be negotiated by anyone unless the probate estate is open and the personal representative's appointment remains effective. The check may be returned to the remitter with a request that it be reissued to the surviving spouse.
