Disparate impact

Disparate treatment is still illegal but didn't the Supreme Court overrule disparate impact cases?
Answer: 

No. The Supreme court has accepted challenges to disparate impact cases but has ruled that disparate impact is still a valid theory of law. The Department of Housing and Urban Development recently proposed rules that will make it more difficult for plaintiffs to use the disparate impact theory.
