EHL Logo on Letterhead

Answered by:

Question:
We like to put "Member FDIC" on our letterhead just to be sure. I can't find information on the Equal Housing Lender logo though and I wonder if it needs to be there?
Answer:

You can review the FDIC rules Section 383 for the specifics on this. I use the term "housing related" (better defined below), and if what you are sending on the letterhead is advertising a housing related loan, yes it should be there. If the letterhead is for general use, it need not be there.

"Any bank which directly or through third parties engages in any form of advertising of any loan for the purpose of purchasing, constructing, improving, repairing, or maintaining a dwelling or any loan secured by a dwelling shall prominently indicate in such advertisement, in a manner appropriate to the advertising medium and format utilized, that the bank makes such loans without regard to race, color, religion, national origin, sex, handicap, or familial status."

OCC banks continue to use the EHL logo although the OCC requirements referred to a section in the HUD rules which were deleted years ago. The OCC has not replaced the requirements with a new set of rules, but it is a best practice to which most national banks adhere.
