Giving ATM Video Tapes To Law Enforcement

Answered by:

Question:
Law enforcement recently demanded our video tape for an incident that occurred at our ATM. Should we give them the entire video tape? Are there privacy issues involved here? I'm looking for some guidelines to follow. There was no subpoena involved.
Answer:

Law enforcement can "demand" all they want - you better not think about giving them that tape. You'll be open for all kinds of lawsuits! What you CAN do is either require a subpoena, or get a "hold-harmless" statement from them, and sit down with them in your office, and review JUST the part of the tape they are concerned with. That tape should NEVER show up in a courtroom without a subpoena!
