Handling creditors of deceased customer

Answered by:

Question:
If a creditor inquires about a debt owed how would it be handled with the Privacy Act?
Answer:

The bank is not in a position to discuss such matters without a court order or subpoena or some state statute that specifically permits such a discussion. A creditor may learn of the deceased individual’s assets and debts by reviewing the appropriate probate court filings – but not by contacting your institution.
