That is my recommendation. If you have to go to court, would you rather hold the position that one confirmation button was for each party, or that each party had the option to click, even though you had no real control over who was doing the clicking?
Just because you meet E-SIGN requirements does not mean you have a good contract. In one way or another you want to confirm the intent of each party entering your agreement.
