Is a late ACH return an automatic loss?

Question: 
If we miss the ACH return deadline, do we just have to write off the loss?
Answer: 

You can write it off, but you may not have to. Some extenuating circumstances can allow for late returns. Other situations may warrant a call to the ODFI for permission to return late, or you can collect out of the network. The ODFI’s liability for transactions is governed by state law; that makes them liable for transactions to up to 7 years in some states!
