Must Remote Deposit ATMs Accept from Non-Customers

Our bank has begun operating ATMs which do imaged check and cash deposit. Our processor told us that ATMs not located at a branch location (i.e. remote ATMs) must accept deposits from non-customers. They can't cite law to that effect. Is this law, or just how they want us to do it?
Answer: 

It's certainly not Federal law, and I doubt that a state would impose such a requirement. That leaves the possibility that one of the networks that your ATM accesses has an operating rule that requires it. Check the operating rule or network contract. If you don't find anything there, tell the processor that unless there's documentation of the requirement, you won't open the ATM to interchange deposits.

Remember, the processor works for you, not the other way around.
