Privacy Policy: Signed or Not?

Answered by:

Question:
Is a signed privacy policy required to be in the file for real estate loans, or only documentation that a privacy policy was mailed/hand delivered to the borrower?
Answer:

There is no requirement for the privacy disclosure to be signed. The bank needs to be able to demonstrate that its process includes delivery of the notice. Many bank include it in the disclosures that print out for a loan closing, which is adequate proof of a satisfactory process for loans customers.
