Our customer was dumb and knew it so we split the loss on the claim rather than denied it altogether. We deserve points for that!
Answer: 

No, you don’t. The Reg is specific to say that negligence by the customer does not increase their liability. It even uses the example of writing a PIN on the card as something you cannot hold against a customer.
