Social Security Deposites & Levies

Answered by:

Question:
I recently did a levy on a customers account. He is now claiming that it was Social Security deposits and we have no right to perform a levy against it. Once it is in an account though, how can we distinguish the difference. Please advise what we are supposed to do?
Answer:

I happen to be in the camp that says once the funds are deposited and commingled with other depositor funds, they lose their identity as social security funds. The Ninth Circuit might not agree. I suggest you consult local counsel on this question. First published on BankersOnline.com 10/7/02
