Structuring your paid leave policy

Answered by:

Question:
If I am an employer, may I use the paid sick leave mandated under the Emergency Paid Sick Leave Act (EPSLA) to satisfy paid leave entitlements that an employee may have under my paid leave policy?
Answer:

No, unless your employee agrees. Absent the employee’s agreement, there are certain things you cannot do; with the employee’s agreement, you have other options. The choice may affect the tax credits the bank is entitled to.
