Can the time frame for error claim resolution involving an ATM (45days) be extended to 90 days if the ATM is in a foreign country, just as it can when it involves a debit card purchace transaction?

Are we required to send a quarterly statement to our Passbook Savings customers if there are no electronic transactions that post to the customer's account? We have a Statement Savings account that a customer can use for ATM transactions and to set up electronic activity and we do send the required statements monthly if there is electronic activity and quarterly if there is not, but on our Passbook Savings, since we update the passbook each time a customer brings it into the bank we only generate a statement if the customer has an electronic transaction post to the account. The Passbook Savings cannot be accessed with an ATM card, but we do not block a customer from setting up an electronic transaction.

We have a customer that is highly disabled and unable to take care of herself without outside help. She needed cash and gave her ATM card to this person along with the PIN so that she could get cash. The helper withdrew unauthorized additional funds. Our customer filed dispute with us. My questions are we released from giving her funds back since she gave the PIN? Also, can we make her file a police report and press charges against the person or we'll withhold her funds?

Does Reg E only pertain to transactions where a PIN was used? If we're a Visa issuer and they require a signed letter from the customer to process a chargeback, can we make that a condition of the denial should the customer fail to return a signed letter to us?

A customer notified us four days after debit card (Mastercard) was stolen. Unauthorized transaction appeared two days after theft and in his statement he identifies the person he thinks stole the card. Do I give him provisional credit less $50.00?

A customer uses a foreign ATM to do a withdrawal and does not receive the funds they withdrew. Which dispute form is appropriate to use for Reg E Compliance?

We have a member that has given her ATM card and PIN to her son. Her son IS NOT on the account. He has "lost" the card, and now she is disputing the charges from other ATMs. Does Reg E apply even though he is not on the account?

We are making disclosure changes for the funds availability change that goes into effect July 21st. We updated Reg CC, but not sure if we have to update Reg E (cash back with deposit to ATM). Do these two items have to match? We would like to keep the ATM limit at $100 (reduce loss exposure) but we want to make sure Reg E allows it -- OR does this part of Reg E have to match funds availability in Reg CC?

A person makes out a deposit slip at the ATM to deposit $3,000.00 into their bank account. The ATM system immediately credits their account for the $3,000.00. They also receive credit for the $3,000.00 when the deposit transaction is retrieved from the machine. They don't notice for a few days until they check their online banking that $3,000.00 was credited to their account twice. Upon looking at the statement, it shows that there were two $3,000.00 deposits in the account. The thought is naturally that the error will be detected and the amount withdrawn. It has now been fourteen (14) months and has shown up on two bank statements. The questions: 1) Is there any law covering whether or not the money becomes the property of the account holder after a certain amount of time, and if so, what rights does the account holder have? 2) The account gets closed say after ninety (90) days, and the error is still not detected, but they find it fourteen (14) months down the road. Would they be able to pursue legal action?
