We have an EFT dispute on a Pinned ATM transaction. The customer withdrew money from another bank's ATM (which shows on her statement). She did not receive the funds. We entered a dispute on the transaction. The other banks ATM was in balance and we have been denied payment on the dispute. Under Reg E, can we reverse the provisional credit we gave to our customer?
Is it considered a law violation to close the investigation prior to the extended periods of 45 and 90 days, even when you provisionally credited the client and complied with all the Reg E requirements?
