One of our customer's debit cards was used as an ATM debit by another family member. Evidently, the customer gave the family member the PIN number for it to work, although the customer said they did not give them permission to use the card. What is our liability?

Is there any time limit on when a debit card transaction would not be valid if it has not cleared the customer's account? For example, a check is not valid after 6 months.

How does Check 21 affect the ACH or EFT transaction? Does it allow for posting (debits and/or credits) to accounts on Saturdays, Sundays and Holidays?

How are transactions from internet banking sites viewed when a money market account is involved? The Reg does not address transfers via internet sites. Are these considered the same as telephone withdrawals?

We have a customer who had his wallet stolen. He had our check card, a card from “Our Bank” and one from “His Credit Union” in his wallet. “His Credit Union” card was used at an ATM and money was taken from his checking and savings account. “His Credit Union” told him that they think it was his negligence that the card was used, so they will not give him his money back. How can we determine if it was his negligence? And he wants to put in a complaint with someone or talk to someone about this and what his liability is. Please advise me as to what agency/regulator he can contact to resolve this situation.

I have a customer that has reported some unauthorized ATM transactions. During our investigation, we uncovered what could be considered negligence on the customer's part. What is our liability to refund the customer's money under Reg E?

Several of our customer accounts were recently accessed through a fraud scheme where fraudulent debit cards were produced and used to access the accounts. The bank has refunded the customers' money. A recent article on MSNBC implied that banks were not required to refund the money. Can you clarify this issue?
