FDIC releases October enforcement actions

The FDIC has released a list of enforcement actions taken against banks and individuals in October 2022. Among the orders listed were:

  • A consent order for a $320,500 civil money penalty to be paid by Cadence Bank, Tupelo, Mississippi, for a pattern or practice of violations of the National Flood Protection Act and Part 308 of the FDIC's Rules and Regulations. This was the largest FDIC civil money penalty for flood insurance violations this year, and almost three times the sum of the FDIC's previous 17 flood insurance penalties for 2022.
  • A consent order assessing a $15,000 civil money penalty against the President and CEO of Peoples Bank, Clifton, Tennessee, for a 2016 violation of Regulation O ยงย 215.5(d).
  • A consent order assessing a $20,000 civil money penalty against a loan officer for TBK Bank, SSB, Dallas, Texas (f/k/a Colorado East Bank & Trust, Lamar, Colorado), after a finding that he had, between 2015 and 2016, failed to disclose to bank management loans in which he had a personal financial interest, including loan proceeds paid for his own benefit.
