We are a growing bank and have 40+ employees. Sometime in the past, I remember hearing 50 as a magical number where the employer has additional requirements.

If that is true, what additional regulations might an employer face when they grow to 50 or more employees? Also, is it an actual headcount, or FTE?

Check the US Department of Labor website. You should be able to find information there. I believe one regulation has to do with FMLA.

The FMLA applies to banks with 50+ employees, whether they are part-time or full-time. Don't use FTE's, count everyone.

You will also need an full-blown affirmative action program if you are a government contractor (savings bond agent).

Thank you all - maybe we should stay at 49 :-(

Is the 50 employees a headcount or FTE? I tried to read the DOL website, but compared to the FRB or OCC, it was too confusing.

It's my understanding that the trigger is 50 employees within a 75 mile radius so all employees do not have to be at the same bank to trigger FMLA issues. My vote would be to stay at 49!!!
