Our bank is migrating towards E-Statements. I have read and re-read the InfoVault Q & A's, but have yet to find an answer or clarification of this. Any help is appreciates.

I see a large number of entries talking about e-mailing the periodic statement to the customer and the requirements to do so. But what if we are not e-mailing them the statements? All of our statements are available on our website to download and view? When signing up a customer for Internet Banking are we supposed to be going thru all the E-Sign requirements, namely the demonstratable consent??

Generally, you email them a notice that says their statement is now available and they would need to go to the bank's website to download.

The value of e-statements is that you don't have to mail paper statements to them if they agree to electronic ones. But for this to happen, you do need demonstratable consent, and follow e-sign requirements. You have to ensure they have the ability to receive your email, then pull these up.
