What type of bank - State or National?

There are no different rules for de-novo banks under Regulation O.

For lending limits, the OCC has some exceptions available for small banks. For State banks you would have to check your State laws.

Situation - FDIC bank - just slightly over 3 years old - does the denovo limits still apply or can they lend up to the 25% rule (if secured by readily marketable collateral)? I know that Denovo timeframe changed to 7 years so that's why I am asking...
