Our CEO is working with LOs who want to work on a sales commission only basis as Outside Sales Originators for secondary mortgage loans only. Is this possible considering the DOLs FLSA recent ruling? Our state follows the FLSA and to be considered exempt, they must not spend more than 20% of their time in the office doing "non-sales" related duties to keep the "outside sales" exemption. Any suggestions! thanks.

The Mortgage Loan Manager thinks that this would be a monumental task of tracking to prove the exempt status is maintained by the "outside sales" originators.
