I had posted a similar scenario as above ^ however I was under the impression that the E-SIGN consent and opt in could not be included in as part of the same package as the early disclosures. I was thinking you had to have consent etc in a prior communication.

You can, but BeachFlyBoy pointed out the problems with that approach.
