When making a loan to a sole proprietorship can you list the 'DBA' under the individuals name and SSN?

If I have a matured line of credit secured by a UCC filing on inventory and accounts receivable and my customer files bankruptcy, assuming my collateral is now under the jurisdiction of the court, is my collateral protected? If not, is there anything I can do to protect it?

We have a real estate loan that is in the name of a Family Living Trust'. Now they want a home equity loan for that trust. Is there a problem with that?

We have continued a UCC one week and six months before the expiration date. How do we correct this? Our original UCC expires on January 2, 2002 and the continuation was filed June 28, 2001. I have never had this happen and wouldn't like to guess.

I have a question about Endorsements on checks: If there is no endorsement on the back of the check drawn on Bank A in the amount of $20,000 and it is payable to Mary Doe deposited at Bank B in Oklahoma do I return it for lack of endorsement? I thought there was a law passed a few years back that any check with an Oklahoma bank of first deposit stamped on the back you did not have to get the payee's endorsement unless it was a two party check or payable to a business. The Okla. bank automatically guarantees the endorsement. Have all the states adopt this ruling?

How long does a company have to file an affidavit of forgery for an altered check? The payee was chemically washed and altered 2 years ago. The original check was just recently located. Has the time limit for filing a claim expired?

When a check is payable to two parties without "and" or "or" written on it, do I need one signature or two?

Our bank policy is not to accept checks payable to the bank when the customer wants cash. Often times the customer has already completed the check payable to the bank before reaching the teller line. Our tellers want to cross off the bank's name and have the customer write in "cash". Any thoughts on this?

I've heard that when parents set up a trust fund for their minor children, they can designate any age they want for the child to be able to access the account. I heard about one where the child couldn't get to the account until he's 35. Is this true? If it is, it seems like a grevious violation of the child's rights!
