Generally, the Equal Housing Opportunity logo is applicable to housing offered for sale or rent. See 24 CFR 110. The Equal Housing Lender logo, on the other hand, is applicable to loans for purchasing, constructing, improving or maintaining a dwelling. That said, the answer really depends on your regulator. OCC regulated institutions are not required to comply with either of these advertising requirements. Federal Reserve regulated institutions must use the Equal Housing Lender logo. FDIC and NCUA regulated institutions may use either the “Equal Housing Lender” logo or “Equal Housing Opportunity” logo.
