The OCC issued a Consent Order of Prohibition and for a $100,000 civil money penalty to Francis Eversman, former president, chief operating officer, and director of Tempo Bank, A FSB, of Trenton, Illinois.

The Comptroller found, and Eversman neither admits nor denies that Eversman, between October 17, 2013, and August 4, 2016, while in his role as Chief Operating Officer and performing the durites of a senior loan officer:

  • caused the Bank to originate 15 nominee mortgage loans, totaling $3,588,800, for the benefit of a third party, by collecting the information for the loan package and submitting the loan package to the Loan Committee for approval; and
  • caused the Bank to originate 15 nominee mortgage loans, totaling $3,588,800, for the benefit of a third party, by collecting the information for the loan package and submitting the loan package to the Loan Committee for approval; and
  • between March 29, 2017, and March 10, 2020, concealed the existence of the nominee loans from the Bank and/or the OCC.
